Design Pickle Partner Program via PartnerStack
Effective Date: 10/01/2025
By participating in the Design Pickle Partner Program, you agree to these Program Terms in addition to PartnerStack's Partner Terms of Service. In the event of any conflict between these terms and PartnerStack's terms, PartnerStack's terms will govern platform-related matters, and these terms will govern Design Pickle program-specific rules.
1. Program Overview
The Design Pickle Partner Program allows you to earn commissions by referring new customers to Design Pickle's creative services platform. Commissions are tracked, managed, and paid through PartnerStack.
2. Commission Structure
Annual Accelerator Tiers
Commissions are based on the number of eligible referrals you generate per calendar year (January 1 - December 31):
Referrals 1-2: $1,000 per referral
Referrals 3-4: $1,500 per referral
Referrals 5+: $2,000 per referral
Your tier resets to $1,000 per referral on January 1 of each year.
Payout Timing
Commissions are paid via PartnerStack the month after they are earned. A commission is "earned" once the referred customer has remained an active, paying customer for more than 31 consecutive days.
Example: A referral that signs up in May and remains active through their 31st day (in June) will have their commission paid out in July.
3. Eligible Referrals
A referral qualifies for commission only when all of the following conditions are met:
Customer Requirements
The customer clicked through your unique PartnerStack tracking link before signing up
The customer is a new customer who has never previously subscribed to Design Pickle
The customer signed up for a paid Design Pickle creative services plan
The customer remained an active, paying customer for more than 31 consecutive days
4. Ineligible Referrals
The following do not qualify for commission:
Self-referrals (signups by you, your company, employees, or family members)
Existing or former Design Pickle customers
Accounts created for the purpose of earning commissions
Customers referred before you joined the Partner Program
Customers who cancel or request a refund within the first 31 days
Final Determination
Design Pickle reserves the right to determine referral eligibility and to approve or deny any commission at our sole discretion, as permitted by PartnerStack's terms.
5. Exclusive Partner Perk
Every customer you refer receives an exclusive benefit: +1 extra daily design hour for their first 90 days (a $2,550 value). This perk is automatically applied when customers sign up through your unique tracking link.
You may promote this perk in your marketing materials when referring customers.
6. Tracking & Attribution
Tracking Links
All referrals must be tracked using your unique PartnerStack tracking links available in your program dashboard. Referrals that do not use your tracking link cannot be attributed to you and will not earn commissions.
Cookie Window
Design Pickle uses a 60-day cookie window. If a prospect clicks your link and signs up within 60 days, the referral will be attributed to you.
Attribution Model
Design Pickle uses a last-click attribution model. The partner whose link was most recently clicked before signup receives credit.
Dual Attribution: In cases where both a partner referral link and an internal Design Pickle representative are involved in a sale, both parties may receive credit. Partner commissions are not reduced in dual attribution scenarios.
Disputed Attribution
Design Pickle reserves the right to make final determinations on disputed or unclear attribution cases.
7. Commission Reversals & Clawbacks
Automatic Reversals
Commissions will be automatically reversed if:
The referred customer cancels within the first 31 days
The referred customer never completes payment
The referral is determined to be ineligible under Section 3
Clawback Period
If a referred customer requests a refund, disputes their payment (chargeback), or is found to be fraudulent within 90 days of their signup, Design Pickle reserves the right to reverse the commission.
If the commission has already been paid to you, Design Pickle may deduct the reversed amount from future commissions owed, or request repayment through PartnerStack's platform mechanisms.
8. Partner Conduct & Prohibited Activities
Required Conduct
As a Design Pickle partner, you agree to:
Use approved marketing materials or request written approval before creating custom promotional content
Disclose your affiliate relationship in compliance with FTC guidelines (U.S.) or equivalent regulations in your jurisdiction
Accurately represent Design Pickle's services, pricing, features, and capabilities
Keep your PartnerStack account information current and accurate
Comply with all applicable laws including privacy, anti-spam, and advertising regulations
Prohibited Activities
You may not:
Engage in fraudulent activity, including but not limited to: fake signups, incentivized signups, self-referrals, or misrepresenting referral sources
Run paid search ads (Google Ads, Bing Ads, etc.) bidding on "Design Pickle," "DesignPickle," or any Design Pickle branded keywords or misspellings
Misrepresent Design Pickle's services, pricing, terms, or partner program earnings potential
Use spam, deceptive subject lines, or misleading marketing practices
Impersonate Design Pickle employees, support staff, or official channels
Use Design Pickle trademarks or brand assets in domain names, social media handles, or app names without written permission
Promote Design Pickle through adult content, illegal activities, hate speech, or other objectionable content
Make income claims about the partner program (e.g., "Earn $50,000 per year as a Design Pickle partner") without written approval and proper disclaimers
Enforcement
Violation of these conduct rules may result in:
Immediate termination from the Partner Program
Forfeiture of pending commissions
Clawback of previously paid commissions related to fraudulent activity
Legal action, if applicable
9. Marketing Materials & Brand Usage
Approved Assets
Partners may use marketing materials provided in the PartnerStack Resource Library, including:
Co-branded landing pages
Email templates
Social media graphics and copy
Newsletter blocks
Custom Materials
Any custom marketing materials, content, or creative assets featuring Design Pickle's brand, logo, or trademarks require written approval before use. Email [email protected] for approval requests.
Intellectual Property
Design Pickle retains all intellectual property rights to its brand assets, trademarks, and marketing materials. Upon termination of your participation, you must immediately cease use of all Design Pickle brand assets and remove them from your properties.
10. Termination
Voluntary Termination
Either party may terminate participation in the Partner Program at any time by providing written notice via PartnerStack or email.
Termination by Design Pickle
Design Pickle may terminate your participation immediately and without prior notice if you:
Violate these Partner Program Terms
Violate PartnerStack's Partner Terms of Service
Engage in fraudulent, deceptive, or unethical conduct
Misuse Design Pickle's brand or intellectual property
Fail to comply with applicable laws
Effect of Termination
Upon termination:
Your access to tracking links and partner resources will be revoked
You must immediately cease all promotion of Design Pickle and remove all brand materials from your properties
Earned commissions (referrals that completed 31+ days before termination) will be paid according to normal schedule
Pending commissions (referrals not yet at 31 days) may be forfeited at Design Pickle's discretion, particularly in cases of termination for cause
Sections 6 (Clawbacks), 8 (IP Rights), 10 (Confidentiality), 11 (Liability), and 12 (Relationship) survive termination
11. Confidentiality
You agree not to disclose any non-public, confidential, or proprietary information about Design Pickle's business operations, internal systems, customer data, or trade secrets that you may learn through your participation in the Partner Program.
Public information, including commission rates and program details available on the PartnerStack marketplace, may be shared freely.
12. Representations, Warranties & Liability
No Guarantees
Design Pickle makes no guarantees regarding:
The amount of commissions you will earn
The traffic or conversions your promotional efforts will generate
The availability or continuity of the Partner Program
Partner Warranties
You represent and warrant that:
You have the legal capacity to enter into this agreement
Your participation will comply with all applicable laws
Your promotional activities will not infringe on any third-party rights
Indemnification
You agree to indemnify and hold harmless Design Pickle from any claims, damages, or losses arising from:
Your breach of these terms
Your promotional activities
Your misrepresentation of Design Pickle or its services
Your violation of applicable laws
Limitation of Liability
To the maximum extent permitted by law, Design Pickle's total liability to you under these terms is limited to the total commissions paid to you in the 12 months preceding any claim.
Design Pickle is not liable for any indirect, incidental, consequential, or punitive damages arising from your participation in the Partner Program.
13. Relationship of Parties
You are an independent contractor. Nothing in these terms creates an employment relationship, partnership, joint venture, or agency relationship between you and Design Pickle.
You have no authority to:
Bind Design Pickle to any contract or obligation
Make representations on behalf of Design Pickle beyond approved marketing materials
Access Design Pickle's internal systems or customer data (except as provided through PartnerStack)
14. Tax Obligations
You are solely responsible for determining and paying any taxes applicable to commissions you earn through the Partner Program.
For U.S.-based partners earning $600 or more per calendar year, Design Pickle (via PartnerStack) will issue a Form 1099-NEC as required by law.
Non-U.S. partners are responsible for complying with their local tax obligations.
15. Modifications to Terms
Design Pickle reserves the right to modify these Partner Program Terms at any time. We will provide notice of material changes via:
Email to your PartnerStack account email
Notice in your PartnerStack program dashboard
Update to the "Effective Date" at the top of these terms
Continued participation after notice of changes constitutes acceptance of the modified terms. If you do not agree to the changes, you may terminate your participation as described in Section 9.
16. Modifications to Commission Structure
Design Pickle reserves the right to modify the commission structure, tiers, or payout terms at any time without prior notice.
Changes will apply to referrals made after the effective date of the change. Previously earned or pending commissions will be paid according to the structure in effect when the referral occurred.
We will make reasonable efforts to communicate changes via email or your PartnerStack dashboard, but continued participation in the program after such changes constitutes acceptance of the new structure.
17. General Provisions
Entire Agreement
These Partner Program Terms, together with PartnerStack's Partner Terms of Service, constitute the entire agreement between you and Design Pickle regarding the Partner Program.
Severability
If any provision of these terms is found to be unenforceable, the remaining provisions will remain in full effect.
No Waiver
Design Pickle's failure to enforce any provision of these terms does not waive our right to enforce it in the future.
Assignment
You may not assign or transfer your rights or obligations under these terms without Design Pickle's written consent. Design Pickle may assign these terms without restriction.
Governing Law
These terms are governed by the laws of the State of Arizona, United States, without regard to conflict of law principles.
Dispute Resolution
Any disputes arising from these terms will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Phoenix, Arizona. Each party will bear its own costs and attorney's fees.
